Stare decisis 一词原为拉丁语 stare decisis et non quieta movered 简称，意思是：依判决提出主张而不干扰未被干扰者（stand by decisions and not disturb the undisturbed ）， 即法院在一般情况下， 应遵守或严守既定判决先例，并不去干扰已经解决的事物。
英美的判例法与我国法律实行的的成文法不同。但是判例法也不是指简单地根据先前生效判决来对现有案件作出相同或相似判决，而是指普通法系的遵循先例原则 (stare ecisis et non quieta movere) 它包括以下几层意思：第一，类似案件类似处理；第二，遵循先例是遵循先例所蕴含的对其他类似案件具有类似拘束力的规则和原则；第三，前案与后案存在重要的事差异时，不适用遵循先例原则。
